The GDPR — Are You Ready?

The new European Union General Data Protection Regulation (GDPR), which takes effect May 25, 2018, replaces the previous Data Protection Directive (Directive 95/46/EC) and introduces a number of new privacy-related requirements for entities that use or process data in the EU, or that use or process data about EU citizens anywhere in the world. This presentation will provide an overview of GDPR requirements, including the provision of adequate security for personal data, obtaining consent from data owners to use their personal data, providing data owners with access to their data upon request, respecting the right to be forgotten and data erasure, processes for reporting data breaches, and processes for the safe cross-border transfer of personal data. Penalties for non-compliance can run to the higher of 20 million Euros or four percent of an organization’s global annual turnover, so this presentation will also provide practical guidance on achieving compliance.

Our presenter will be Jeff Jacobs, Esq., a graduate of the University of Chicago Law School with over 15 years of litigation experience as an outside and in-house counsel and over ten years of experience managing or consulting on information governance and electronic discovery matters.  Jeff is currently the Senior Director for Information Governance and Litigation Readiness Consulting at Epiq, where he advises clients on information governance, data privacy, cross-border discovery, litigation readiness, discovery process design and validation, data preservation, and strategies for the management of complex litigation discovery matters.
Prior to joining Epiq, Jeff served as Associate General Counsel for MCI, where he managed the discovery in connection with the WorldCom accounting fraud investigations and related securities litigation, the WorldCom bankruptcy, and the antitrust review of MCI’s acquisition by Verizon.  He also served as counsel to the Company’s Records and Information Management (RIM) group, advising on records, data and email retention and disposition.  Before that, Jeff was a Special Counsel in the litigation group of Sullivan & Cromwell’s Washington, DC office, representing multi-national companies on litigation and regulatory compliance matters.
Jeff has presented numerous CLE programs on information governance, data privacy, litigation readiness, electronic discovery, records management and ethical issues in discovery, and was a member of the charter (first) class to be certified as an Electronic Discovery Specialist by the Association of Certified Electronic Discovery Specialists (ACEDS).
