How You’ll Help Us Better Service Our Clients
Due to our continued growth and strategic focus on expanding our private client services, we are seeking to recruit a 7+ year call Lawyer in our Estates & Trusts practice group, with focused experience in estate litigation. This is a unique opportunity to build your expertise within a sophisticated and growing estate and trust litigation practice, acting on high-value and high-stakes disputes for executors, trustees, beneficiaries, committees, and families.
Clark Wilson provides a strong platform to develop your practice, with an established and loyal client base, cross-referrals from our Litigation, Corporate, Tax, and Private Client groups, and mentorship from experienced practitioners. You will work on complex and meaningful matters, including wills variation claims, contested estate and trust administration, passing of accounts proceedings, fiduciary disputes, and incapacity-related applications. This is an ideal opportunity for a lawyer who is motivated to grow their practice, develop long-term client relationships, and play an integral role in the continued expansion of our Estates & Trusts group.
What You’ll Be Doing
This is an ideal opportunity if you are seeking to establish yourself as a senior member of a leading Estates & Trusts practice while advising clients on sophisticated, high-stakes disputes and developing your own practice with the support of a collaborative and well-established firm platform.
You will have the opportunity to work on a broad range of sophisticated estate litigation matters, including:
- Advising executors, trustees, beneficiaries, and families in contested estate and trust disputes;
- Managing files from start to finish, from early strategy through resolution;
- Drafting pleadings, affidavits, applications, and settlement materials;
- Preparing for and attending discoveries, mediations, hearings, and trials;
- Appearing before the Supreme Court of British Columbia (and other relevant tribunals, as needed);
- Guiding clients through capacity-related disputes and committeeship applications where required;
- Working with colleagues across the firm on matters with corporate, tax, real estate, or family angles; and
- Supporting practice growth through strong client service, referrals, and mentorship of junior lawyers and students.
Representative matters may include wills variation claims, disputes about capacity or undue influence, passing of accounts, executor or trustee disputes, and other contested estate and trust matters resolved through negotiation, mediation, applications, or trial.
How You’ll Be a Great Fit for This Role
We seek a lawyer who is technically strong, client-focused, and motivated to grow their practice and progress toward partnership. The successful candidate will demonstrate the following attributes:
- membership in good standing with the Law Society of British Columbia;
- 7+ years of experience practicing in estates and trusts, with significant experience in estate and trust litigation;
- strong technical knowledge of estates, trusts, and estate litigation principles, procedures, and remedies in British Columbia;
- the ability to independently manage files and client relationships with confidence and professionalism;
- excellent communication skills, both written and oral, with the ability to build and maintain trusted client relationships;
- strong analytical, drafting, and problem-solving skills;
- sound judgment and professionalism when handling confidential and sensitive client matters; and
- an entrepreneurial mindset and interest in contributing to practice growth and progression toward partnership.
