  • Incident Response with Modest Resources

    “You’re going to need a bigger boat.” Sheriff Brody said it best when he came face to face with the great white shark that was menacing the fictitious town of Amity Island, in Spielberg’s 1975 blockbuster, Jaws. Yet the hero was able to stop the shark without a bigger boat. He uses ingenuity and determination.

    The same holds true when it comes to defending against cyber attacks in small to mid-sized law firms. Security operations statistics demonstrate that compared to large law firms, smaller firms generate significantly fewer security incidents, but are close to par when it comes to events requiring an immediate response. But, unlike larger firms with more resources with which to protect client non-public information, small firms can find themselves trapped between cyber attacks like ransomware that do not prejudice based on the size of the firm, and regulators who are indifferent to your size when investigating a potential violation. Nonetheless, smaller firms must use their modest resources wisely to establish and practice incident response. This workshop will be a demonstration of how to effectively respond to a cyber breach or incident both from a technical and a business perspective, and how to mitigate future risks using modest resources

Though the root cause is by no means malicious, we have begun to reward speed over quality, distractedness over focus, action over reflection, and the negative effects suffered in people’s personal and professional lives are beginning to add up. This predicament ought to be a wake-up call for all of us. A return to balance between three components of productive thought is needed; Creative Thinking, Critical Thinking, and Applied Thinking. In other words, how can we ensure people are practicing Open Thinking? “Dream, decide, do, repeat” is the mantra best-selling author Dan Pontefract wants us to consider.

    Dan is the best-selling author of three books: OPEN TO THINK: Slow Down, Think Creatively, and Make Better Decisions (2018), THE PURPOSE EFFECT: Building Meaning in Yourself, Your Role and Your Organization (2016) and FLAT ARMY: Creating a Connected and Engaged Organization (2013). Dan is also an Adjunct Professor at the University of Victoria, Gustavson School of Business.

    He is the founder and CEO of The Pontefract Group a firm that improves the state of leadership and organizational culture.

    Previously, as Chief Envisioner of TELUS he founded the Transformation Office in 2014 to help organizations enhance their corporate culture, leadership, learning, work styles & collaboration practices. As Chief Learning Officer at TELUS, Dan was responsible for the overarching leadership, collaboration & learning strategy for the company. Dan championed the introduction of the TELUS Leadership Philosophy (TLP), a collaborative-based leadership framework for 50,000+ team members. In parallel to these actions he drove a philosophical and cultural shift in the way TELUS views and experiences learning called “Pervasive Learning” the shift to a social, informal and formal learning model. He further championed the use and deployment of collaborative technologies to complement both the leadership and learning frameworks. Between 2008 and 2018, employee engagement at TELUS soared from 53% to nearly 90%. Dan’s innovation also led to the introduction of the TELUS MBA—run in partnership with the University of Victoria—which allows TELUS team members the opportunity to garner an MBA over a two-year period. The program has won three international awards and delivered new revenues and savings in excess of $300 million.

    His career is interwoven with both corporate and academic experience, coupled with an MBA, B.Ed and multiple industry certifications and accreditations. Dan is also a renowned speaker and has been invited to deliver over 300 external keynotes and presentations, including four TED Talks. In 2012 he appeared on the front cover of T+D Magazine and Chief Learning Officer Magazine. Dan also writes for Forbes, Harvard Business Review and The Huffington Post.

    In 2010, Dan was acknowledged by CLO as a ‘Vanguard Award’ winner and is a 2-time winner by the Corporate University Best in Class Awards of the ‘Leader of the Year’ in both 2010 and 2011. In 2012, SkillSoft awarded Dan the ‘Learning Leader of the Year’ for his work at TELUS and CLO Magazine bestowed the ‘Learning in Practice Innovation Award’ as well. He is also the recipient of the 2012 Brandon-Hall ‘Gold Award in Strategy & Governance’. In 2015, TELUS became a 10-time winner of the prestigious ‘ATD BEST’ award under his leadership and was the first ever recipient of the ATD Hall of Fame distinction. In 2013 and 2014, TELUS also placed in the top ten of the Learning! 100 Awards.

    John Ahern is a Vancouver lawyer and Certified Fraud Examiner (CFE) who, among other things, currently serves as National Special Advisor, RCMP Federal Policing Criminal Operations. Prior to returning to private practice in 2017, Mr. Ahern was Senior Crown Counsel with the BC Ministry of Justice for more than 20 years, where his province-wide practice focused on the prosecution of serious financial crime. Before becoming a lawyer, Mr. Ahern served 17 years as a peace officer with Canada Customs, the Peel Regional Police, and the RCMP, mostly in front line policing and criminal investigations.

     

    Topic: Money Laundering and Accountants

    Mr. Ahern brings his extensive background in fraud to the topic of money laundering. In his presentation Mr. Ahern will focus on money laundering, accountants and the law firm, including: the role that lawyers and accountants play as gatekeepers to the financial system, the manner in which money launderers seek to exploit lawyers and accountants, and current Law Society of BC anti-money laundering Rules and initiatives. If time allows, we will also cover some current issues of special interest to BC lawyers and accountants, notably the use of real estate transactions and lawyers’ trust accounts to launder the proceeds of crime and evade taxation.

In 2010, she served as the only Canadian elected to the international Legal Marketing Association Board of Directors in that year.

    Now, with more than 20 years of experience in the legal professional, she has worked on some of the most demanding large-scale projects of the profession and claims to have maintained her sense of humour throughout each challenge. She has advised on and implemented international merger communications, conducted marketing audits, built and enhanced small and massive websites, navigated firms through full-scale corporate identity reviews and more.

    Amid a weakening global backdrop and escalating trade tensions, the outlook for the B.C. economy has softened recently. The sale of established residential properties and consumer spending have been key soft spots. But with the external economic climate becoming less supportive, activity in the province’s export is also beginning to sag. The B.C. economy, however, is well-positioned to weather choppy waters as it will continue to benefit from reasonably strong population growth, which is helping sustain employment growth .

    The outlook for B.C. over the next couple of years is also bolstered by an unprecedented level of non-residential construction activity, including high levels of government investment in schools, hospitals, and energy and transportation infrastructure. A medium-term concern is the fact that a number of recent tax increases and an increasingly complex regulatory environment are undermining B.C.’s competitive position and prompting businesses to be more cautious about making large capital investments in the province, especially on the land base.
