This session will provide a practical, scenario-driven overview of employee accommodation obligations under human rights legislation. Through a review of key legal principles and real-world examples, participants will gain a clearer understanding of how to identify accommodation requests, respond appropriately, and manage risk while supporting employees effectively.

Framework: Key Legal Considerations

The session will begin with a high-level review of the legal framework governing accommodation requests, including:

  • What constitutes an accommodation, when the duty to accommodate is triggered, and how employers are expected to respond
  • Accommodating employees with recognized disabilities, including mental health conditions and addictions
  • Managing the return-to-work process following medical leave, including common pitfalls, employer obligations, and when termination may be appropriate
  • The definition of “disability” under human rights legislation and the scope of an employer’s duty to reasonably accommodate, including obligations to consider alternative work when an employee can no longer perform their original duties

 Practical Scenarios

Participants will work through some common real-world examples of possible accommodation requests.
